TM BioWater, Inc. — Website Terms and Conditions

1. Use of Website. These Terms govern use of the TM BioWater, Inc. website. By using the Site, you agree to these Terms. Site content is provided for general business and informational purposes and does not constitute medical, scientific, regulatory, or legal advice.
2. Research-Use Products. TM BioWater products offered through this Site are supplied solely for the laboratory and research uses stated on their labeling. Unless expressly authorized under a separate written agreement, they are not intended for human or veterinary administration, diagnosis, treatment, prevention, or other clinical use. Products must not be injected, ingested, administered, or used to prepare, compound, dilute, or reconstitute substances intended for human or veterinary administration. Product labeling and lot-specific documentation control over general Site content.
References to USP standards, testing, registration, product listing, NDC information, Certificates of Conformance, or similar regulatory or quality information do not constitute FDA approval or authorization for any use inconsistent with product labeling.
3. Product Information and Orders. Product descriptions, photographs, specifications, packaging, availability, and other Site content may change without notice. Submitting an inquiry or request for quotation does not create a binding order. Purchases are governed by the applicable quotation, order confirmation, invoice, and any separately executed agreement with TM BioWater.
4. Intellectual Property. The Site and its text, photographs, trademarks, logos, designs, and other content are owned by or licensed to TM BioWater and may not be reproduced or commercially used without written permission.
Purchase of a product does not transfer any rights in TM BioWater technology, manufacturing processes, know-how, trade secrets, trademarks, or other intellectual property.
5. Disclaimer and Limitation of Liability. The Site and its content are provided “as is” to the maximum extent permitted by law. TM BioWater disclaims implied warranties relating to the Site, including merchantability, fitness for a particular purpose, and non-infringement. TM BioWater will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site or from unauthorized, prohibited, or off-label use of its products. Nothing in these Terms limits liability that cannot lawfully be limited.
6. Privacy; Governing Law; Contact. Use of personal information is governed by the TM BioWater Privacy Policy. These Terms are governed by Louisiana law, and disputes relating to the Site will be subject to the state and federal courts located in Orleans Parish, Louisiana, unless a separate written agreement provides otherwise.
